Chapter 1: General Provisions

Article 1 [Definitions]

  4. Purchaser
    A person who applies for a product in accordance with the procedures set forth by the Shop and having understood and accepted all of the terms and conditions of this Agreement and the Privacy Policy.
  5. User
    A person who searches for, browses, or uses images, text, designs, logos, images, programs, ideas, or other information ("Content") provided by the Shop through the Service upon understanding and accepting the Terms and Conditions and the Privacy Policy.

Article 2 [Application of these Terms and Conditions]

These Terms and Conditions govern the use by Users of the Services provided by the Shop via the Internet. Users are deemed to have accepted these Terms of Use at the time they begin using the Service.

Article 3 [Modification of the Terms and Conditions]

The Shop may modify these Terms and Conditions within the scope of the purpose of the Service, if the Shop deems it necessary. The use of the Service by Users and Purchasers after the modification of these Terms of Use shall be deemed as acceptance of the modified Terms of Use.


Chapter 2: Purchase of Goods

Article 4 [Purchase of Products]

  • Users may use the Service to purchase products from the Shop.
  • When a User wishes to purchase a Product, the User shall apply for the purchase of the Product in accordance with the procedures separately stipulated by the Shop.
  • A purchase contract for the relevant Product shall be deemed to be formed when the User clicks the "Place Order" button after confirming the delivery address, order details, and other information entered and registered by the User, and when an email confirming the order details is subsequently received by the User from the Shop. Notwithstanding the provisions of the preceding paragraph, the Service will not be provided to the User.
  • Notwithstanding the provisions of the preceding paragraph, in the event of fraudulent or inappropriate use of the Service, the Shop reserves the right to cancel or terminate the purchase agreement or take other appropriate measures.
  • Minors may not purchase products using the Service without the prior consent of a qualified legal representative.

Article 5 [Change of Registered Information]

Purchasers shall promptly notify the Shop of any change in all or part of the name, address, or other information entered at the time of purchase or otherwise notified to the Shop. In addition, even if a change is registered, transactions that have already been completed before the change is registered shall be conducted based on the information provided prior to the change.

Article 6 [Payment Method]

  • The amount to be paid for a product shall be the total of the selling price of the product as displayed on the website, plus shipping and handling charges.
  • Payment for products purchased through the Service must be made by the payment method specified by the Shop.
  • If payment is made by credit card, it shall be subject to the terms and conditions separately agreed upon by the purchaser with the credit card company. In the event that any dispute arises between the purchaser and the credit card company in connection with the use of a credit card, the purchaser shall be responsible for resolving the dispute between the purchaser and the credit card company.
  • In the case of a separate agreement (including, but not limited to, agreement to the terms and conditions of the payment method) between the purchaser and the payment company that owns the payment method, the purchaser shall follow the terms and conditions of the separate agreement. In the event that any dispute arises between the Purchaser and the payment company in relation to such means of payment, the Purchaser and the payment company shall be responsible for resolving the dispute.

Article 7 [Return of Products]

The Shop shall handle the return of products from the Purchaser in accordance with the "Return Policy" section of the "Legal Notice" posted on the website.



Chapter 3: Handling of Personal Information

Article 8 [Handling of Personal Information]

The Shop will handle personal information in accordance with the Privacy Policy separately stipulated by the Shop.

 

Chapter 4: Responsibilities in Use

Article 9 [Prohibited Matters]

The following acts are prohibited in connection with the use of the Service by Users or Purchasers.

  1. Causing or threatening to cause any trouble, disadvantage, or damage to other Users, third parties, or the Shop.
  2. Infringing or threatening to infringe the copyrights, trademarks, patents, other intellectual property rights, portrait rights, personal rights, privacy rights, publicity rights, or other rights of other Users, third parties, or the Shop.
  3. Actions that are or may be offensive to public order and morals, or that violate laws and regulations.
  4. Acts that use content obtained through this service outside the scope of private use by the User or Purchaser.
  5. Using the Shop's products to reveal the secrets of the products to others, including through video media such as SNS (including the act of showing information about gimmick cards to a third party or disclosing procedures related to tricks).
  6. Purchasing products from the Shop for the purpose of resale.
  7. Reproducing, selling, publishing, distributing, or disclosing the contents obtained through this service through other users or third parties other than other users, or any similar acts.
  8. Interfering with the operation of the Service or other services provided by the Shop.
  9. Any activity that the Shop reasonably deems inappropriate, such as damaging or destroying the Shop's credibility.
  10. Any other conduct that the Shop deems inappropriate.

 

Chapter 5: Disclaimer

Article 10 [Disclaimer]

  1. The Shop shall not be liable for any damages incurred by a third party as a result of a User's or Purchaser's violation of these Terms of Use.
  2. The Shop does not guarantee the completeness, accuracy, certainty, usefulness, or any other aspect of the contents of the Service or any information obtained by the User or the Purchaser through the Service.
  3. In principle, the Shop shall not be liable to users and purchasers for any damages arising from the use of the Service, and shall not be obligated to compensate for such damages. However, in the event that the disclaimer does not apply due to reasons such as the contract between the Shop and the user or purchaser falls under a consumer contract as defined in Article 2.3 of the Consumer Contract Act (Act No. 61 of 2000), the provisions of these Terms and Conditions that completely disclaim the Shop's liability shall not apply. The provisions of these Terms and Conditions that completely exempt the Shop from liability shall not apply in such cases. In the event that a contract under these Terms and Conditions constitutes a consumer contract and the Shop is liable for damages based on default or tort, except in the case of willful misconduct or gross negligence on the part of the Shop, the amount paid by the user or purchaser to the Shop under these Terms and Conditions during the past one year from the date the damage occurred shall be considered as the maximum amount of damages. The maximum amount of damages for which the Shop shall be liable shall be the amount paid by the User or the Purchaser to the Shop under these Terms and Conditions during the past one (1) year from the date of the damage.
  4. In the event that the Purchaser fails or refuses to pick up the merchandise, is unable to pick up the merchandise due to a long absence, or is unable to find the delivery address, or is otherwise unable to pick up the merchandise for any reason, the Shop shall be liable for damages up to the amount paid by the User or the Purchaser to the Shop under these Terms and Conditions within one (1) year from the date of purchase. In such cases, the Purchaser shall fulfill its obligation to deliver the Products and be released from such obligation by contacting the contact registered by the Purchaser and bringing or delivering the Products to the delivery address designated at the time of purchase of the Products.

 

Chapter 6: Miscellaneous Provisions

Article 11 [Copyrights, Intellectual Property Rights]

The contents provided through the Service shall belong exclusively to the Shop or third parties with legitimate rights. In the event that a problem arises between a user or purchaser and a third party in violation of the provisions of this Article, such user or purchaser shall resolve such problem at his/her own responsibility and expense, and shall not cause any damage, loss, or disadvantage to the Shop.


Article 12 [Governing Law]

These Terms and Conditions shall be governed by and construed in accordance with the laws of Japan.


Article 13 [Consultation and Jurisdiction]

In the event that any matter is not stipulated in these Terms and Conditions or any question arises regarding the interpretation of these Terms and Conditions, the Shop, the User, or the Buyer shall promptly resolve the matter through consultation in accordance with the principle of good faith and belief. All disputes arising out of or relating to this Agreement shall be subject to the exclusive jurisdiction of the court of first instance having jurisdiction over the location of the Shop.
